Criminal cases
The criminal case is divided into two parts:
1- General criminal lawsuit: It is the lawsuit that relates to the crimes that infringe on the public right, and is represented in the crimes that directly affect the state or society.
For example: general hudud crimes, such as the crime of adultery and warfare (corruption on earth), as well as crimes of discretion for sins that involve the right of God Almighty.
This part of the lawsuit is in charge of filing and initiating it before the competent court: The Public Prosecutor of the Bureau of Investigation and Public Prosecution, as Article No. (16) of the Code of Criminal Procedure stipulated that.
2- A special criminal case: It is a lawsuit that proceeds to the crime that is an assault on a private right, such as crimes of retribution in general, whether in self or without, as well as discretionary crimes that involve an assault on individual rights.
This part of the lawsuit is filed by the victim or his representative or his heir after him, and this is what Article No. (17) of the system stipulates.
